New Solicitor says Emmaus Council has Right to Remain Silent
Attorney Jeffrey Dimmich told council members that they are not obligated to answer questions during the public comment portion of Emmaus Borough Council meetings.
In his first official appearance as Emmaus solicitor Monday night, Jeffrey Dimmich told that they need not be “interrogated” during the public appeals portion of borough council meetings.
Dimmich’s advice to council came on the heels of a complaint registered by borough resident Anthony Groller, who approached council during the public comment part of the meeting. Groller wanted to register his concerns about having seen borough employees entering soon after clocking in at their borough jobs.
Dimmich told council: “If you desire to answer questions you may do so. If you do not desire to answer questions, you do not have to do so. You can address it, or not address it, at some other time.”

Complaints regarding borough employees need to go to the borough manager, Shane Pepe, before being brought to a council meeting, Dimmich said. And if that fails to resolve the problem, the complaint would then be brought to council, he added.
Dimmich, of the law firm Dimmich & Dinkelacker, P.C. in Orefield, replaces Frank Procyk of the Allentown firm Fonzone and Ashley as Emmaus solicitor.
